SERVICE TERMS AND CONDITIONS
BOOKING FEE & PAYMENT
A nonrefundable booking fee is required to reserve the Client’s session date and time. The booking fee is NONREFUNDABLE and is applied toward the total cost of the Client’s photography package.
The booking fee compensates the Photographer for reserving the selected date and time, removing that appointment from availability to other clients, and the administrative work associated with scheduling and preparing for the session.
The session is not considered booked or reserved until the booking fee has been paid and this Agreement has been completed.
If the Client cancels the session for any reason, the booking fee will not be refunded. If the Photographer is unable to provide the contracted services and an alternative date cannot be mutually agreed upon, the booking fee will be refunded.
Any remaining balance is due on the date of the session unless otherwise agreed to in writing.
AGE REQUIREMENT
Sexy Beautiful Me provides photography services exclusively to Clients who are 21 years of age or older, with a limited exception for bridal boudoir sessions.
At the Photographer’s discretion, a Client who is 18 years of age or older may be accepted for a bridal boudoir session when the session is being photographed in connection with the Client’s upcoming wedding.
By booking a session and signing this Agreement, the Client represents and confirms that they meet the applicable minimum age requirement.
The Photographer reserves the right to request a valid government issued photo ID to verify the Client’s identity and age. If the Client is unable or unwilling to provide acceptable proof of age when requested, the Photographer may refuse or terminate the session.
Clients under the age of 18 will not be photographed under any circumstances, including with the permission or consent of a parent, guardian, spouse, or other individual.
If a Client misrepresents their age or does not meet the applicable age requirement for the session booked, the Photographer may cancel the session and any payments made will be forfeited, to the extent permitted by applicable law.
CANCELLATIONS & POSTPONEMENTS
Sessions may be rescheduled one (1) time with a minimum of fifteen (15) days’ written notice, subject to availability.
Postponements made with fewer than fifteen (15) days’ notice, no shows, failure to attend, or failure to communicate will result in forfeiture of the session and require a new booking to reschedule.
ALL SALES ARE FINAL
Except as expressly provided elsewhere in this Agreement, all payments are nonrefundable and nontransferable.
Dissatisfaction based on appearance, posing, wardrobe, artistic preferences, personal expectations, or other matters specifically addressed within this Agreement does not constitute grounds for a refund, credit, complimentary reshoot, or other compensation.
CLIENT ILLNESS
Clients should not attend a session while experiencing a contagious illness or symptoms that could reasonably expose the Photographer or others within the residence to illness.
The Photographer reserves the right to refuse entry, discontinue a session, or require rescheduling if the Client arrives visibly ill or reports symptoms of a potentially contagious illness.
Any rescheduling resulting from Client illness remains subject to the cancellation and postponement provisions of this Agreement unless otherwise agreed to by the Photographer in writing.
HAIR & MAKEUP
When hair and makeup services are NOT included:
The client must arrive camera ready.
Clients are welcome to bring hair and makeup products for touch ups between wardrobe changes.
Non-electric styling products may be brought for touch ups.
Touch up time is included in the appointment and may reduce available photography time.
When hair and makeup services ARE included in or ADDED to the Client’s package:
The Client must arrive with a clean face and clean, completely dry hair.
Hair styling includes curling and basic styling of the Client’s natural hair using hot tools. Updos, braids, blowouts, or specific or complex hairstyles are not included.
The application, curling, or styling of clip in hair extensions is not included and may require an additional fee determined by the stylist. Clients planning to wear clip in extensions must notify the Photographer in advance so adequate styling time can be scheduled. Extension services cannot be guaranteed if requested on the day of the session.
Clients with known makeup allergies or sensitivities are responsible for bringing their own suitable makeup products for the stylist to apply. Clients must also disclose any known allergy or sensitivity to false eyelashes or lash adhesive before application.
Hair and makeup are styled specifically for photography. Certain requested looks or techniques, including very heavy eyeliner or other makeup that may not photograph well, may be modified or declined at the discretion of the Photographer or stylist.
The Client is responsible for communicating any concerns, preferences, or requested changes to the stylist before the photography portion of the session begins so adjustments can be made. Once photography begins, the Client is considered to have accepted the completed hair and makeup.
Dissatisfaction with hair, makeup, or how the Client appears in the photographs does not constitute grounds for a refund, credit, complimentary reshoot, or other compensation.
WARDROBE DISCLAIMER
Sexy Beautiful Me does not provide wardrobe, lingerie, clothing, shoes, or accessories.
The Client is responsible for bringing all items they wish to wear and ensuring that all wardrobe fits properly prior to the session.
The Photographer does not guarantee that all items brought will be photographed. Wardrobe selection is based on available time, fit, styling, the Client’s comfort, and what the Photographer determines will photograph best.
Sexy Beautiful Me does not edit, alter, or correct wardrobe that does not fit properly, including but not limited to tightness, gaping, bunching, or visible undergarments.
Failure to bring suitable, properly fitting wardrobe, or dissatisfaction with wardrobe appearance, does not constitute grounds for a refund, rescheduling, additional photography time, complimentary reshoot, or additional retouching.
SESSION DURATION
Clients should plan to be at the studio longer than the photography time included with their session to allow for arrival, preparation, wardrobe changes, and other necessary transitions.
The session time listed in the selected package refers to active photography time. Late arrival, additional preparation, indecision, touch ups, or excessive time spent on wardrobe changes may reduce the amount of photography time available.
LATE ARRIVAL
Late arrival reduces the Client’s available session time and does not extend the scheduled appointment.
Arrivals more than 30 minutes late may result in cancellation of the session without refund.
No additional photography time will be provided to compensate for Client lateness.
ACCESSIBILITY & ACCOMMODATIONS
If you require accessibility accommodations, you must contact the Photographer BEFORE booking your session. This allows the Photographer to determine whether the studio can reasonably accommodate your needs or, when necessary, confirm the availability of an alternative suitable location before you reserve a date and submit payment. Please do not complete your booking until the Photographer has confirmed the appropriate arrangements with you.
When relocation is necessary specifically as a reasonable accessibility accommodation, the Client will not be charged an additional studio rental fee. Complimentary relocation is provided as an accessibility accommodation and does not constitute a complimentary commercial studio upgrade.
If the Client books a session before notifying the Photographer of an accessibility need, the Photographer cannot guarantee that an accessible alternative location will be available on the originally reserved date or time. If an alternative accessible location is necessary but unavailable for the scheduled session, the Client may select another mutually available date and time when an appropriate location is available.
A request for an accessibility accommodation made after booking does not, by itself, cancel the Client’s existing reservation or make otherwise nonrefundable booking fees or payments refundable. The Photographer’s standard cancellation, rescheduling, payment, and no show policies continue to apply equally to all Clients, except when a reasonable modification is required by applicable law.
Clients are not required to disclose a diagnosis, medical history, or other private medical information. The Client only needs to provide sufficient information regarding the accommodation needed for the Photographer to determine an appropriate arrangement.
LOCATION RULES
Only the individual being photographed is permitted in the photography area.
The following are strictly prohibited:
• Guests, partners, or children
• Pets
• Weapons
• Alcohol or drugs
• Body fragrances or tanning products
• Personal photography, video, or recording of any kind
Arriving under the influence of alcohol or drugs will result in immediate cancellation without refund.
Failure to comply with studio rules may result in immediate termination of the session without refund.
PROPERTY DAMAGE
The Client agrees to treat the Photographer’s residence, furnishings, equipment, sets, props, and personal property with reasonable care.
The Client is financially responsible for the reasonable cost of repair, replacement, professional cleaning, or remediation resulting from damage caused by the Client beyond ordinary wear and tear.
This includes, but is not limited to, damage or staining caused by makeup, tanning products, hair products, food, beverages, footwear, wardrobe, or negligent handling of furnishings, props, or photography equipment.
POSING & DIRECTION
All posing is fully guided and will be adjusted based on the Client’s comfort, mobility, physical abilities, and limitations.
The Client is responsible for informing the Photographer before the session of any injuries, medical conditions, physical limitations, mobility concerns, or restrictions that may affect movement, posing, or balance.
Images displayed on the Photographer’s website, portfolio, social media, or other materials are examples of previous work and are not a guarantee that the same poses can or will be recreated during the Client’s session. Every Client has different physical abilities, proportions, flexibility, mobility, and comfort levels.
The Photographer will determine and modify poses as appropriate for each individual Client and may decline or discontinue any pose the Photographer believes cannot be performed safely.
The Client understands that physical limitations may prevent certain poses from being attempted or recreated. The inability to perform a particular pose or achieve an image identical or similar to an example from the Photographer’s portfolio does not constitute a failure to provide the contracted photography services.
Dissatisfaction resulting from an inability to perform or recreate a particular pose due to the Client’s comfort, mobility, physical ability, flexibility, or limitations does not entitle the Client to a refund, credit, complimentary reshoot, or other compensation.
By participating in the session, the Client acknowledges that posing may involve standing, sitting, bending, lying down, kneeling, or shifting positions. The Client should immediately notify the Photographer if any pose or movement causes pain, discomfort, dizziness, instability, or concern.
Sexy Beautiful Me is not responsible for injuries, strains, or physical discomfort resulting from the Client’s voluntary participation in posing or movement during the session, except to the extent liability cannot legally be limited or excluded.
ARTISTIC STYLE & CREATIVE DISCRETION
The Client acknowledges that they have had an opportunity to review the Photographer’s portfolio and are familiar with the Photographer’s photographic and artistic style. Photography is a creative service, and individual sessions and final images will vary.
The Photographer retains creative discretion regarding lighting, posing, composition, camera angles, backgrounds, cropping, image selection, styling, and other artistic decisions.
No particular pose, photograph, background, composition, expression, or number of photographs from any particular wardrobe, pose, or setup is guaranteed unless expressly stated in the Client’s purchased package.
Images from previous sessions are examples of the Photographer’s work and do not guarantee that identical or substantially similar photographs will be created.
Studio furnishings, sets, props, décor, backgrounds, bedding, and accessories are subject to change without notice. No particular furnishing, set, prop, background, or decorative element appearing in previous photographs is guaranteed to be available for the Client’s session.
Differences in appearance, location, lighting, wardrobe, physical ability, body type, available sets, furnishings, and other circumstances may produce results different from photographs displayed in the Photographer’s portfolio.
Dissatisfaction based solely on personal taste, expectations, or artistic preferences does not constitute grounds for a refund, complimentary reshoot, additional editing, or other compensation.
IMAGE SELECTION & PRODUCTS
Following the session, the Client will receive access to a private online gallery for the purpose of selecting the images included with the purchased package.
All image selections are final once submitted. Images may not be exchanged, replaced, or changed after selections have been submitted. The Client is responsible for carefully reviewing all selections before submitting them.
Turnaround time begins only after the Client has completed and submitted all required image selections. Any delay in making selections will result in a corresponding delay in final image delivery.
The Client agrees to complete image selections within the timeframe provided by the Photographer. Failure to make selections within a reasonable timeframe may delay editing, product production, album design, and final delivery.
Online selection galleries are provided for viewing and selection purposes only. Images displayed in a selection gallery are not final delivered photographs and may be unedited, lightly edited, watermarked, or otherwise prepared solely for proofing purposes.
Screenshots, screen recordings, downloads, copying, saving, photographing the screen, or otherwise reproducing images from a selection gallery are prohibited. Access to the gallery does not constitute delivery of the photographs or grant the Client permission to copy, publish, share, alter, or use proofing images.
All photographs displayed in an online gallery remain the copyrighted property of Sexy Beautiful Me.
Additional images, albums, prints, or other products may be available for purchase separately. Additional purchases are subject to the pricing and terms in effect at the time of purchase.
POST PRODUCTION & EDITING
Unselected images may be permanently deleted after the Client’s selected photographs have been delivered.
Standard editing includes:
• Color correction
• Exposure and composition adjustments
• Light skin softening, which the Client may request to have reduced or omitted prior to editing
• Removal of small, temporary blemishes such as pimples or minor bruises
Standard editing does NOT include:
• Altering body size or proportions
• Skin tone correction beyond basic color balancing, including uneven tone, discoloration, or sunburn
• Removal of tattoos, scars, stretch marks, or permanent features
• Advanced retouching techniques
Dissatisfaction with appearance, body shape, skin tone, hair, makeup, wardrobe, or personal features is not grounds for re-editing, refunds, credits, or complimentary reshoots.
Advanced editing may be available for an additional fee and is not guaranteed.
RAW files are not released.
All editing decisions are made at the Photographer’s professional discretion.
DELIVERY & CLIENT BACKUP
Digital images are generally delivered approximately two to three weeks after the Client completes their image selections.
Digital files are delivered through an online link that remains active for approximately 10 business days.
The Client is responsible for promptly downloading and backing up all delivered files.
Sexy Beautiful Me does not guarantee indefinite storage of Client photographs and is not responsible for expired gallery links, files lost by the Client after delivery, third-party download issues, device failure, or the Client’s failure to maintain adequate backups.
IMAGE LOSS, EQUIPMENT FAILURE & LIMITATION OF LIABILITY
The Photographer takes reasonable precautions to protect Client images and maintain professional photography equipment. However, photography and digital storage involve equipment and technology that may occasionally fail.
In the unlikely event that photographs are lost, damaged, corrupted, destroyed, stolen, or otherwise become unavailable due to equipment malfunction, memory card failure, computer or storage failure, file corruption, theft, accident, third-party service failure, or circumstances beyond the Photographer’s reasonable control, the Photographer will make reasonable efforts to recover the affected images.
If a substantial portion of the Client’s photographs cannot be delivered, the Photographer may offer a reshoot when reasonably possible. If a reshoot is not reasonably possible or the Photographer is unable to provide the contracted photography services, the Photographer’s maximum financial liability will be limited to the amount actually paid by the Client for the affected photography services.
Sexy Beautiful Me, LLC will not be responsible for consequential, incidental, indirect, emotional, or other damages arising from the loss or unavailability of photographs, to the extent permitted by applicable law.
COPYRIGHT & CLIENT IMAGE USAGE
The Photographer retains copyright ownership of all photographs created during the session.
The Client receives a personal use license for final purchased and delivered digital photographs, including permission to print those photographs for personal use.
The Client may not sell, license, commercially distribute, or use the photographs for advertising, business, promotional, resale, or other commercial purposes without written authorization from the Photographer.
The Client may not claim authorship of the photographs.
The personal use license applies only to final photographs purchased by and delivered to the Client. Proofs, unselected photographs, RAW files, screenshots, and other images not delivered as final purchased photographs are not included in the license.
Unauthorized use may result in appropriate legal action.
CONFIDENTIALITY & PRIVACY
All studio materials, session information, pricing, packages, processes, and business practices are proprietary to Sexy Beautiful Me and may not be copied, distributed, shared with other photographers, or used for commercial purposes or to establish or assist a competing photography business.
Sexy Beautiful Me respects the private and personal nature of boudoir photography. Client images will NOT be used for marketing, social media, website content, advertising, portfolio use, or any other public or promotional purpose without the Client’s written consent.
The Client is never required to grant permission for images to be shared.
Personal information and private details shared with the Photographer in connection with the session will be treated as confidential and will not be intentionally disclosed to third parties except when reasonably necessary to provide the contracted services or when required by law.
STUDIO RIGHT TO REFUSE OR TERMINATE SERVICES
Sexy Beautiful Me, LLC reserves the right to refuse entry, terminate a session, or refuse further services when reasonably necessary because of Client conduct, including but not limited to failure to follow studio policies, inappropriate or threatening conduct, harassment, disruptive behavior, intentional property damage, unsafe behavior, or arriving under the influence of drugs or alcohol.
When services are terminated because of the Client’s prohibited conduct or material violation of this Agreement, no refund or credit will be issued, except where otherwise required by law.
If the Photographer must cancel because of the Photographer’s inability to perform and the parties cannot mutually agree upon an alternative date, the Client will receive a refund of payments made for services that cannot be provided.
FORCE MAJEURE
Sexy Beautiful Me, LLC will not be considered in breach of this Agreement when performance is delayed, rescheduled, or prevented because of circumstances beyond its reasonable control, including but not limited to severe weather, hurricanes, flooding, fire, power outages, government orders, public emergencies, natural disasters, widespread utility or infrastructure failures, or other unforeseen events outside the Photographer’s reasonable control.
When reasonably possible, the Photographer will offer rescheduling to a future mutually available date.
No guarantee is made regarding the timeframe within which rescheduling will be available.
NON DISPARAGEMENT
The Client agrees not to knowingly publish, post, or communicate false or defamatory statements concerning Sexy Beautiful Me, LLC, its owner, or its services.
Nothing in this Agreement prohibits the Client from expressing an honest opinion, providing a truthful review, describing their factual experience, communicating with an attorney or government agency, or exercising any other right protected by applicable law.
ENTIRE AGREEMENT & MODIFICATIONS
This Agreement, together with the Client’s selected photography package and any written addenda or modifications accepted by both parties, constitutes the entire agreement between the Client and Sexy Beautiful Me, LLC concerning the photography services.
Any material modification to this Agreement or the services purchased must be agreed to in writing.
Informal conversations, social media messages, examples from previous sessions, promotional photographs, or other communications do not modify the terms of this Agreement unless the modification is expressly agreed to in writing by the Photographer.
SEVERABILITY
If any provision of this Agreement is determined to be invalid, illegal, or unenforceable, that provision will be limited or removed only to the extent necessary, and the remaining provisions of this Agreement will remain in effect to the fullest extent permitted by law.
GOVERNING LAW
This Agreement will be governed by and interpreted in accordance with the laws of the State of Florida.
Any provision concerning the location or venue of legal proceedings shall be subject to applicable Florida law.
ELECTRONIC SIGNATURES
The Client agrees that this Agreement may be executed electronically and that an electronic signature or other electronic acceptance of this Agreement will have the same effect as a handwritten signature to the extent permitted by applicable law.
AGREEMENT ACKNOWLEDGEMENT
By booking an appointment, the Client confirms that they have read and understood the terms and conditions and voluntarily agree to be bound by them.
The Client acknowledges that they have had the opportunity to ask questions regarding these terms before booking their session.
